TERMS OF SERVICE last updated October 18, 2026
OVERVIEW
This website is operated by glassqueenz LLC, the independent glass art practice of artist Zeinab Manesh.
Through glassqueenz, I offer handmade glass artwork, functional glass pieces, decorative objects, and collectible works created through my artistic practice. These Terms of Service govern your use of this website and purchases made through it.
Throughout these Terms, “glassqueenz,” “I,” “me,” and “my” refer to glassqueenz LLC and the artist Zeinab Manesh, as applicable.
By visiting this website, browsing the collections, or placing an order, you agree to these Terms of Service (“Terms”) and the additional policies referenced here. Please read them carefully before making a purchase. If you do not agree to these Terms, do not use the website or its services.
These Terms apply to website visitors, customers, and other users. Additional terms may apply to particular products, commissions, or services where disclosed.
My online store is hosted by Shopify, which provides the e-commerce platform used to offer products and process orders.
SECTION 1 — ONLINE STORE TERMS
You must be legally able to enter into a binding agreement to make a purchase. If you are below the age of majority in your jurisdiction, you may use the website only with the involvement and consent of a parent or legal guardian where required by law.
You agree not to use the website or products for unlawful purposes or to violate applicable laws or regulations, including intellectual property laws.
You must not transmit malicious code, viruses, or other material intended to damage, disrupt, or interfere with the website or its systems.
I may suspend or restrict access where reasonably necessary to address fraud, security concerns, unlawful conduct, or material violations of these Terms, subject to applicable law.
SECTION 2 — GENERAL CONDITIONS
I reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, unauthorized transactions, inventory errors, material pricing errors, or misuse of the website.
Information submitted through the website may be transmitted through third-party networks and service providers as necessary to operate the store and process transactions. Payment information is handled through the applicable payment processors and their systems.
You may not reproduce, copy, resell, or commercially exploit the website, its original content, or access to its services without prior written permission, except where permitted by law.
Headings are included for convenience and do not change the meaning of these Terms.
SECTION 3 — WEBSITE INFORMATION
I make reasonable efforts to keep product listings, descriptions, prices, and other website information accurate and current. However, errors, omissions, or outdated information may occasionally occur.
Information about my artistic practice, techniques, collections, and future work is provided for general informational purposes. Statements about future collections or potential availability do not guarantee that a particular item will be produced or offered for sale.
If I discover a material error affecting an order, I may contact you to discuss an appropriate resolution, including cancellation and a refund where applicable.
I may update website content when necessary, but I will not use this provision to avoid obligations relating to an accepted order or rights provided by law.
SECTION 4 — PRICES AND CHANGES TO THE STORE
Product prices, collections, and availability may change without advance notice, except where applicable law requires otherwise.
As an independent artist, I may create one-of-a-kind works, limited releases, small production runs, and experimental designs. Some pieces may not be reproduced once sold.
I may add, modify, suspend, or discontinue website features or products. Changes will not remove obligations relating to existing orders or agreements.
Applicable taxes and shipping charges will be displayed or communicated during checkout as required.
SECTION 5 — HANDMADE GLASS, PRODUCT DESCRIPTIONS, AND INTENDED USE
5.1 Functional and Decorative Glass Pieces
glassqueenz offers both functional and decorative glass pieces, including handmade artwork and collectible objects. The intended use of each item will be described in its individual product listing where applicable.
A piece described as functional is intended only for the use expressly identified in its listing. For example, a vessel, drinking glass, serving object, or other functional piece should be used only in the manner stated in its product description.
Do not assume that a piece is suitable for food or beverage contact, hot liquids, open flames, candles, ovens, stovetops, microwaves, dishwashers, or sudden temperature changes unless the product listing expressly confirms that use.
Decorative artwork should be used for display unless its listing expressly states that it is also suitable for another purpose.
If a product listing does not clearly identify whether a piece is food-safe, heat-safe, or suitable for a particular functional use, please contact me before using it for that purpose.
5.2 Natural Variations in Handmade Work
Each handmade glass piece is shaped through a process involving heat, movement, tools, and individual finishing techniques. Variations may occur in color, transparency, dimensions, shape, pattern, surface texture, weight, and decorative details.
Small bubbles, lines, marks, and other characteristics may occur as part of the glassmaking process. Where consistent with the product description and the nature of the piece, these characteristics may contribute to its individual character and are not automatically defects.
However, handmade variation does not excuse undisclosed damage, a material defect, an unsafe product, or an item that materially differs from its description.
Unless otherwise stated, measurements are approximate. Where a listing identifies a particular one-of-a-kind piece, the item shown in the listing is the item offered for sale.
5.3 Product Photographs and Color
I make reasonable efforts to photograph and describe each item accurately. Colors, reflections, transparency, and surface details may appear differently depending on lighting, photography, and individual screen settings.
Photographs and videos are intended to represent the work as accurately as reasonably possible. Minor differences caused by lighting or screen settings do not necessarily mean an item is defective, but this provision does not excuse a material misrepresentation.
5.4 Glass Care and Safety
Glass is fragile and may chip, crack, or break if dropped, struck, mishandled, or exposed to conditions for which it was not designed.
Handle glass pieces with care. Use stable display surfaces, appropriate supports, and suitable cleaning methods. Keep fragile pieces away from young children, pets, and areas where they may be knocked over.
Do not expose a piece to direct flame, extreme heat, sudden temperature changes, or other potentially damaging conditions unless the specific product listing expressly states that it is designed for that use.
For functional pieces, follow any care instructions provided with the product or in its listing. If no instructions are provided for a particular use, please ask before proceeding.
Nothing in these Terms excludes any product safety obligation or liability that cannot legally be excluded.
5.5 Product Availability
Many pieces are unique or produced in limited quantities. A sold-out piece may not be available again, and future work may differ from previous examples.
If an order is accepted but I cannot supply the item, I will contact you and provide an appropriate resolution, including a refund where required by law.
SECTION 6 — ORDERS, PAYMENT, AND CUSTOMER INFORMATION
Please review your order, shipping address, and contact information before submitting payment.
You agree to provide accurate and current information needed to process and fulfill your order. If you notice an error, contact me as soon as possible. I cannot guarantee that changes or cancellations can be made after an order has entered processing, packaging, or shipment.
I may decline or cancel an order for legitimate reasons, including suspected fraud, unauthorized payment, material listing errors, or an item becoming unavailable.
If an order is canceled after payment, I will notify you using the information provided at checkout and arrange any refund required by law.
An order confirmation does not override a later notification that an order cannot be fulfilled. Where an order has been accepted, any cancellation or other resolution will be handled in accordance with these Terms and applicable law.
SECTION 7 — SHIPPING, PROCESSING, AND DELIVERY
Processing times, shipping methods, shipping charges, and estimated delivery dates will be provided in the product listing, checkout, or order communications, as applicable.
Delivery dates are estimates unless expressly stated as guaranteed. Carrier delays, weather, service interruptions, and other circumstances may affect delivery.
I will comply with applicable shipping and order-fulfillment requirements. If I cannot ship an order within the time represented at checkout or within the time required by law, I will provide any required notice and cancellation or refund options.
You are responsible for entering a complete and accurate shipping address. If an address is incorrect, contact me as soon as possible. Additional costs for reshipment or address corrections may apply only where permitted by law and appropriately disclosed.
I take professional care when packaging glass artwork for shipment. Nevertheless, damage can occur in transit.
If your order arrives damaged, defective, incorrect, or incomplete, contact me promptly at zeinabm@glassqueenz.com with your order number and clear photographs of the item, packaging, and any visible damage. Retain the original packaging where reasonably possible to help with an assessment or carrier claim.
I will review the report and work toward an appropriate resolution under the Return and Refund Policy and applicable law.
Nothing in this section removes any rights or remedies you may have under applicable law concerning nondelivery, damage, or loss.
SECTION 8 — RETURNS, REFUNDS, AND EXCHANGES
Returns, refunds, and exchanges are governed by the separate Return and Refund Policy published on this website. That policy forms part of these Terms.
Please review it before purchasing. The policy should clearly explain whether returns are accepted, the applicable time limits and conditions, how refunds are issued, and any applicable return-shipping or other fees.
Any restrictions for custom, personalized, sale, or one-of-a-kind pieces must be clearly disclosed and apply only to the extent permitted by law.
Nothing in these Terms or the Return and Refund Policy limits a customer's rights concerning defective, damaged, misdescribed, or otherwise nonconforming goods, or any other rights that cannot lawfully be waived.
A written copy of the refund policy is available upon request.
SECTION 9 — CUSTOM ORDERS AND ARTISTIC COMMISSIONS
I may accept custom orders and commissions at my discretion.
Before work begins, the agreed scope, design, price, payment schedule, estimated completion date, and cancellation terms should be confirmed in writing.
Because glassmaking is an artistic process, exact duplication of a reference image, previous piece, color sample, or specified measurement may not always be possible. Reasonable variations inherent in the process should be expected and discussed before the commission is confirmed.
Any deposit, cancellation fee, or restriction on design changes must be disclosed and agreed upon in advance and must comply with applicable law.
If a commission cannot be completed as agreed, I will communicate with the customer about an appropriate resolution, including any refund required by the agreement or applicable law.
Unless agreed otherwise in writing, purchasing a commissioned physical piece does not transfer copyright or other intellectual property rights in the design.
SECTION 10 — THIRD-PARTY TOOLS AND SERVICES
The website may provide access to third-party tools, applications, payment processors, shipping services, or other features that I do not own or directly control.
These services may be subject to their providers' own terms and privacy policies. I do not guarantee the availability or performance of third-party services and am not responsible for matters outside my reasonable control, subject to applicable law.
Your use of third-party services is at your discretion. Please review the applicable provider's terms and privacy practices.
SECTION 11 — THIRD-PARTY LINKS
This website may include links to third-party websites, platforms, or services for convenience or informational purposes.
I do not control third-party websites and am not responsible for their content, availability, products, or privacy practices. A link does not necessarily imply endorsement.
Your use of a third-party website is governed by that website's terms and policies. This section does not exclude responsibility where applicable law requires otherwise.
SECTION 12 — REVIEWS, FEEDBACK, AND SUBMISSIONS
If you submit a review, suggestion, comment, photograph, or other content, you confirm that you have the right to submit it and that it does not unlawfully infringe another person's rights.
You grant me permission to use feedback to respond to you and improve my products or services. For broader promotional use of your identifiable image, private correspondence, or other personal information, I will obtain any permission required by law.
You must not submit unlawful, fraudulent, threatening, defamatory, abusive, discriminatory, or infringing content, or content containing malicious code.
I may moderate, decline, or remove submitted content where reasonably appropriate and legally permitted. You remain responsible for the content you submit.
SECTION 13 — PRIVACY AND PERSONAL INFORMATION
Personal information collected through the website is handled in accordance with the separate Privacy Policy and applicable law.
Shopify and other service providers may process information as necessary to operate the store, complete payments, prevent fraud, fulfill orders, arrange shipping, and provide customer support.
Please review the Privacy Policy for details about the collection, use, disclosure, and protection of personal information.
SECTION 14 — ERRORS AND CORRECTIONS
Product descriptions, pricing, availability, shipping charges, processing times, promotions, and other website content may occasionally contain errors or omissions.
I reserve the right to correct errors and update information. If a material error affects an order, I may contact you to discuss an appropriate resolution, including cancellation and a refund where applicable.
I will not use this section to avoid obligations relating to an accepted order or to override consumer rights provided by law.
SECTION 15 — PROHIBITED USES
You may not use the website or its content:
- For an unlawful purpose or to solicit unlawful activity.
- To violate applicable laws or regulations.
- To infringe intellectual property or other rights.
- To submit fraudulent or materially misleading information.
- To harass, threaten, abuse, or unlawfully harm another person.
- To transmit malicious code or interfere with website security.
- To collect or misuse another person's personal information unlawfully.
- To engage in spam, phishing, unauthorized scraping, or automated collection of website content.
- To reproduce, manufacture, or commercially exploit glassqueenz artwork or content without authorization, except where permitted by law.
I may restrict access where reasonably necessary to address violations of these Terms, subject to applicable law.
SECTION 16 — INTELLECTUAL PROPERTY AND ARTIST RIGHTS
Original artwork, designs, product photographs, videos, written content, graphics, branding, logos, and other creative materials published by glassqueenz are owned by Zeinab Manesh of glassqueenz LLC, or another relevant rights holder, as applicable.
Purchasing a physical piece transfers ownership of that particular object only. It does not transfer copyright, reproduction rights, or ownership of the underlying design.
Unless expressly authorized in writing or otherwise permitted by law, you may not reproduce, manufacture, distribute, license, commercially exploit, or create derivative works from glassqueenz artwork, photographs, or designs.
Personal, noncommercial sharing of publicly available product images is welcome where it does not misrepresent the work or imply an endorsement that has not been given. Credit to glassqueenz or the artist is appreciated.
Commercial use, reproduction, licensing, and other uses beyond ordinary ownership and display of a purchased piece require prior written authorization unless applicable law provides otherwise.
All rights not expressly granted are reserved.
SECTION 17 — DISCLAIMERS AND LIMITATION OF LIABILITY
I make reasonable efforts to provide reliable website services and accurate product descriptions. However, uninterrupted or error-free website access cannot be guaranteed.
To the fullest extent permitted by applicable law, the website and its digital features are provided on an “as available” basis.
To the extent legally enforceable, the seller will not be liable for indirect, incidental, special, or consequential losses arising from the use of the website or its services.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms excludes applicable statutory warranties or consumer remedies for defective, unsafe, misdescribed, or otherwise nonconforming products.
Any limitation of liability applies only to the extent permitted by the law governing the relevant transaction.
SECTION 18 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify the seller against third-party claims and reasonable expenses arising directly from your unlawful use of the website, infringement of third-party rights, or material violation of these Terms.
This provision does not require you to indemnify the seller for the seller's own conduct where such indemnification would be prohibited by law.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted by law or severed to the extent necessary.
The remaining provisions will continue in effect to the extent legally enforceable.
SECTION 20 — TERMINATION
These Terms remain applicable while you access or use the website and its services, subject to any obligations that survive termination.
You may stop using the website at any time. I may suspend or terminate access where reasonably necessary to address material violations of these Terms, fraud, security concerns, or unlawful activity, subject to applicable law.
Termination does not remove obligations or liabilities arising before termination or affect rights relating to orders already placed or accepted.
SECTION 21 — ENTIRE AGREEMENT
These Terms, together with the policies referenced here and any separate written agreement applicable to a particular transaction, govern your use of the website and services.
If a separate written commission agreement conflicts with these Terms, the commission agreement will govern that commission only to the extent of the conflict and only where valid and enforceable.
Nothing in this section overrides mandatory legal rights or protections.
SECTION 22 — GOVERNING LAW
These Terms are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law principles, except where mandatory law provides otherwise.
Any legal proceeding must be brought in a court with appropriate jurisdiction, subject to applicable consumer protection laws and any mandatory rules concerning venue or jurisdiction.
Nothing in this section limits rights or remedies that cannot legally be waived.
SECTION 23 — CHANGES TO THESE TERMS
The most current version of these Terms will be available on this page.
I may revise these Terms by publishing an updated version and changing the “Last Updated” date. Changes will apply prospectively to the extent required by law and will not retroactively remove rights or obligations relating to existing orders.
Your continued use of the website after revised Terms take effect will constitute acceptance where legally sufficient.
